Hours of Operation

Salisbury Truck Accident Lawyer

Truck drivers on active duty must adhere to the strictest of hours of operations regulations to keep them from operating a truck while exhausted. If they do not, any resulting trucking accident could be placed directly at their feet. In other situations, the parent trucking company has actually informed their drivers to stay out on the highways for extended shifts in an attempt to cut costs and increase profits. In either scenario, the motorists who are often injured in a truck accident case should not be expected to pay for their own recoveries.

If you have been hurt by a commercial truck and you think hours of operation regulation violations may have been at play, do not hesitate to contact Salisbury Truck Accident Lawyer William Hall. With our team here at William R. Hall, P.A. on your side, gaining maximum compensation for your injuries and damages could be as easy as picking up the phone and dialing 410.205.1684 today.

Federal Schedule & Hour Regulations

The Federal Motor Carrier Safety Administration (FMCSA) has decided a “safe” amount of hours a trucker can stay on the highway and behind the wheel. This regulation is applicable to trucks and trucking companies from coast to coast. Any truck driver or their employer who willingly or involuntarily violates these regulations cannot use ignorance as an excuse, as these rules have been firmly established for years.

Hours of operation regulations for truckers in most situations are:

  • No shift can exceed 14 hours.
  • A 14-hour shift must include no more than 11 hours of driving time.
  • For every 8 hours driven, at least one 30 minute break must occur.
  • 10 consecutive hours of off-duty time must exist between shifts.
  • 7/8 day workweek may not be comprised of more than 60/70 hours.
  • 34 consecutive hours of off-duty time must exist between workweeks.

Even when all of these regulations are met, a truck driver can become exhausted. 11 hours behind the wheel, five to six days a week, is an exhausting episode for anyone.
