Types of Tests
The three most common types of field sobriety tests are the Horizontal Gaze Nystagmus (HGN) test, the One-Leg Stand (OLS) test, and the Walk and Turn (W&T) test. These tests are all voluntary. Those suspected of a DWI do not have to perform any of the field sobriety tests; they are mainly used to provide evidence, or probable cause, for a police officer to arrest a person for a DWI and ask him or her to do a breath test at the police station.
Standardization of Tests
There is a right and a wrong way to conduct a field sobriety test. The National Highway Traffic Safety Administration (NHTSA) publishes a manual and conducts training and certification courses for law enforcement in how to properly administer these tests. If an officer doesn’t conduct the test in a proper manner, the tests results could be considered invalid and cannot be considered evidence of impairment.
