What is Assault?
According to Maryland law, an “assault” offense can be a violent crime that is considered assault, battery, or a combination of the two. In other words, Maryland recognizes a variety of assault offenses:
- You can be charged with assault in the first degree if you intentionally cause serious physical injury to another person, attempted to cause serious physical injury to another, or committing assault with a firearm. Serious physical injury is defined as an injury that causes a risk of permanent damage or death. First-degree assault is a felony, punishable by a maximum prison sentence of 25 years.
- You can be charged with assault in the second degree if you are accused of any general assault which doesn’t classify under the rules of first-degree assault. So, if you touch someone else in an unwanted or offensive manner, you can be charged with this offense. While second-degree assault is considered a misdemeanor, it carries a maximum jail or prison sentence of 10 years. However, if the assault was committed on a police or probation officer, it can be charged as a felony.
- Reckless endangerment is also categorized under the assault umbrella in Maryland. The crime occurs when an individual recklessly puts someone else at risk of death or serious physical injury, but not intentionally. It is considered a misdemeanor, punishable by a maximum jail or prison sentence of five years.
