There is a substantial difference between simple possession and possession with intent. Indications of possession with intent include an abundance of drugs or cash, as well as the presence of packaging material.
What are the Penalties for Drug Possession with Intent to Sell in Maryland?
If a person violates this law with a Schedule I or Schedule II narcotic (Heroin, cocaine, crack, MDMA, ecstasy, methamphetamine, LSD, or some prescription drugs), then it is considered a felony offense. Penalties include a maximum prison sentence of 25 years and a fine of up to $25,000.
