What are the Penalties for Possession of Child Pornography?
State Penalties
Depending on the circumstances of the case, you could be charged with any of the following crimes:
- Possession of child pornography
- Production/ distribution of child pornography
If you possess any visual representation of a minor under the age of 16 years who is engaged in sexual conduct, any form of sadomasochistic abuse, or a state of sexual excitement, you could face up to 5 years in prison and/ or be fined up to $2,500 for the 1st offense. For a 2nd or subsequent offense, you could get up to 10 years in prison and/ or be required to pay a fine of up to $10,000.
If you are accused of producing or distributing child pornography, this means someone believes you were involved in soliciting, employing, or allowing a minor to engage in the production of any visual representation that shows them engaging in any sadomasochistic act or sexual conduct. Likewise, by creating any visual representation of the actions described above, or using a computer to create, edit, or store the images, you can also be convicted of producing child pornography. If you intend to promote or distribute them, you might be charged with distributing child pornography. The penalty for doing so for the 1st time is imprisonment for up to 10 years and/ or a fine of up to $25,000. Any subsequent convictions can result in up to 20 years in prison and/ or a fine of up to $50,000.
Federal Penalties
If you are also convicted by a federal court, a 1st-time possession offense could result in a sentence of anywhere from 0 to 10 years in federal custody. The statutory maximum for this offense is 10 years. For subsequent offenses, however, the punishment is 10 to 20 years in federal custody.
For a 1st-time distribution offender, the punishment could be anywhere from 5 to 20 years in federal custody. Repeat offenders will get 15 to 40 years in federal custody.
