Maryland Domestic Violence Laws & Penalties
There is no specific law which prohibits domestic violence in Maryland.
However, defendants accused of assaulting or threatening an intimate partner,
family member, child, or any household member can be charged with first-
or second-degree
assault.
First-degree assault involves intentionally causing or attempting to cause
serious physical harm to someone else, as well as committing assault with
the use of a firearm. It is considered a felony, punishable by a prison
sentence of up to 25 years.
Second-degree assault covers less-severe forms of domestic violence, such
as causing or attempting to cause bodily harm to another person. This
type of assault is punishable by prison sentence of up to 10 years and
a maximum fine of $2,500.
On the other hand, stalking is considered an act of domestic violence.
It is considered a misdemeanor, punishable by a maximum jail sentence
of five years and a fine of up to $5,000.
